General Terms and Conditions VGF WebPortal – Valid from 15/07/2019

(Status: May 2019)

Section 1 Scope of application

(1) The following Terms and Conditions are part of every contract concluded between us, Stadtwerke Verkehrsgesellschaft Frankfurt am Main mbH, Kurt-Schumacher-Straße 8, 60311 Frankfurt am Main, and you via our online shop at www.meine.vgf-ffm.de (hereinafter the “WebPortal”).

(2) In our WebPortal we offer you the opportunity to purchase certain tickets in the Rhein-Main-Verkehrsverbund (hereinafter referred to as “RMV”) - in particular time-limited tickets and subscriptions – (“Ticket”). 

(3) In addition, the Standard RMV Conditions of Carriage apply to the use of the transport service.

Section 2 Conclusion of contract; delivery; payment

(1) The presentation of our services in our WebPortal on www.meine.vgf-ffm.de does not constitute a binding offer on our part. The way in which a contract between you and us is established can be found in our customer information.

(2) We will provide you with the ticket purchased via our WebPortal electronically for transfer to an existing chip card or send you a new chip card on which your ordered ticket is already stored. You can load your existing ticket onto your chip card either at a VGF ticket machine (at the earliest 48 hours after placing your order), or on a corresponding mobile device at your home (immediately after ordering), if you have one. Please note our instructions for issuing the ticket.

(3) We offer you the payment methods mentioned in our customer information. Should the collection of the agreed amount fail for a reason for which you are responsible (e.g. incorrect or outdated data, insufficient funds), you must bear the additional costs incurred as a result. We are also entitled to terminate the contract with you if payment is not made within 14 days after a corresponding request by us.

Section 3 Subscriptions, term, termination

(1) If you select an annual ticket on a subscription basis, the contract will run for an indefinite period.
 
(2) You are entitled to cancel a subscription at any time up until the 10th of a given month, to the end of the month.

(3) Annual tickets are available on a subscription basis at reduced rates. If the contract term at the time of termination (by you) is less than 12 months, you will be in the same position as if you had purchased monthly time-limited tickets for the period actually used. You are, therefore, obligated in retrospect to pay the difference between the discount on the annual ticket and the monthly time-limited ticket for the period actually used (this corresponds to an additional 1/10 of the monthly price paid by you for each month used); however, this will be at most the annual price of the respective ticket.

Section 4 User account

In order to use our WebPortal you must register at www.meine.vgf-ffm.de. You will then receive an e-mail with an activation link which you must click to activate. You can delete your user account yourself at any time; current time-limited tickets remain valid. During the active state of your user account you are obligated to keep the data you have stored there up-to-date. In the event of any false information being provided, we are also entitled to block your user account or, in the event of its misuse, to delete it.

Section 5 Our liability

For our services, which we provide via our WebPortal, the statutory rights of liability for defects shall exist, unless otherwise agreed below:

(1) We are liable – regardless of the legal basis – for damages or compensation for futile expenditure in accordance with the following provisions under letters (a) and (b):

(a) In case of intent or gross negligence we shall be liable without limitation. In the case of simple negligence, we shall only be liable for damages resulting from the breach of a material contractual obligation (obligation whose fulfilment makes the proper execution of the contract possible in the first place and upon whose fulfilment you [may] regularly rely); in this instance, however, our liability shall be limited to compensation for foreseeable damage typical of the contract in question.

(b) The liability resulting from letter (a) shall not apply if we have fraudulently concealed a defect or have given a guarantee for the quality of the item, for damages resulting from injury to life, body or health, or in the case of liability as set out under the Product Liability Act (Produkthaftungsgesetz). 

(2) Insofar as liability vis-a-vis us is excluded or limited, this also applies to the personal liability of our legal representatives and vicarious agents.

Section 6 Consumer dispute resolution

(1 ) The European Commission has provided a platform for out-of-court online dispute resolution, which is available at www.ec.europa.eu/consumers/odr. We are obligated to participate in the dispute resolution procedure. You can, of course, also contact us directly at any time: meine[at]vgf-ffm.de

(2) As a member of the sponsoring association of the dispute resolution body for public passenger transport (söp), a consumer dispute resolution body recognised under the Consumer Dispute Resolution Act (VSBG), VGF is prepared and obligated by the statutes of the association to participate in out-of-court dispute resolution proceedings for the resolution of disputes arising from (or in connection with) this contract.
